LEGAL SUPPORT CENTER “QANTAR” IS CREATED IN KAZAKHSTAN

Dear Kazakhstanis!
We all witnessed the tragic January events in our country. Many of our compatriots took to peaceful protests throughout Kazakhstan with fair demands. Unfortunately, the peaceful protest was discredited by provocateurs, criminals and looters. Today we know about hundreds of dead and missing, about thousands of victims and detained by law enforcement agencies.

Obviously, we cannot turn this tragic page of our history until the truth about what happened is established, until the innocent victims of these events are helped. We clearly separate those who participated in peaceful rallies and expressed their protest within the framework of the law, from those who took advantage of this opportunity to commit illegal acts and crimes.

Finding such criminals is the duty of law enforcement agencies, and we are ready to assist them in this. But our job, as responsible citizens, is to help peaceful protesters and others who have suffered at the hands of criminals and illegal actions of law enforcement agencies.

OUR MISSION

To achieve an objective, fair investigation and punishment of those responsible for the deaths of civilians during the January events, as well as to achieve exemption from unjustified persecution of peaceful demonstrators and persons who accidentally found themselves in the orbit of criminal proceedings.

Facilitate the provision of legal assistance to relatives of the victims, unlawfully prosecuted, victims of torture and violations of other human rights as a result of the events of January 2022.

The results of the meeting of lawyers of the Public Fund with the leadership of the General Prosecutor's Office of the Republic of Kazakhstan

Information about the meeting of lawyers of the Public Foundation "CENTER FOR LEGAL SUPPORT "KANTAR" (hereinafter - the Fund) with the leadership of the General Prosecutor's Office of the Republic of Kazakhstan.

Commissioner for Human Rights in the Republic of Kazakhstan Azimova E.A. On 06/08/2022, a working meeting was organized with the First Deputy Prosecutor General of the Republic of Kazakhstan Tashimbayev T.G., the head of the 1st Service of the General Prosecutor's Office of the Republic of Kazakhstan Shalabaev S.R. and other responsible officials of the supreme oversight body.

At the meeting, the Fund was represented by lawyers G.K. Nurpeisov, A.A. Aidarkhanova and D.K. Kanafin.

The lawyers of the Fund brought to the attention of the participants of the meeting information about the main problems faced by citizens involved in the orbit of criminal proceedings and their lawyers.

So, in particular, it was reported about:
  • delay the investigation of cases of death caused by the use of firearms during the events of January 2022,
  • about the long-term redirection of cases from one law enforcement agency to another, without carrying out the necessary investigative and procedural actions at that time. This attitude has led to the fact that the perpetrators have not yet been identified, that is, even a few months after the death of citizens of our country, the necessary examinations have not been scheduled in a timely manner, and investigative actions aimed at collecting evidence have not been carried out.
The lawyers of the Foundation said that in cases of torture:
  • persons identified by the victims are not recognized as suspects in a timely manner,
  • the investigation of these cases is also delayed,
  • the rights of the victims are not adequately secured,
  • lawyers' appeals do not always receive a proper response.
Separately, the lawyers drew the attention of the leadership of the General Prosecutor's Office to flagrant violations of the rule of law and human rights, for example, the deprivation of liberty of persons taken from hospitals of medical institutions from 01/08/2022 to 01/11-12/2022 without compiling relevant procedural documents and many other facts .

On the part of the employees of the General Prosecutor's Office, they demonstrated understanding and recognition of the listed problems, as well as a desire to solve these problems in the manner prescribed by law. Information about violations in specific cases was submitted to the supervisory authority in the form of relevant certificates from lawyers. In general, the meeting was held in a constructive manner, the lawyers of the Fund hope for an adequate response from the supervisory authority to their demands for the restoration of the rule of law and the violated rights of the represented and protected persons.

The child was injured - the investigation is silent!

There are still no suspects in the criminal case on the fact of causing serious harm to the health of 4-year-old Arunaz, there are no results of examinations. The girl was injured during the events of January 2022. Rinat Baimolda from the lawyer pool of the Qantar Foundation appealed to the President of Kazakhstan with a request to ensure an impartial investigation into the Arunaz case. “As far as we know, all the persons involved in this case have been identified, a number of expert examinations have been appointed. However, within three months we cannot wait for the results of these examinations. So far, there are no suspects in the criminal case, none of the officials has been recognized as such. The boy was injured and the investigation is silent

The suspects in the criminal case of 4-year-old Arunaz, who suffered serious injuries, have not been identified yet, and there are no expert results. A little girl was shot and wounded during the January 2022 events.
